ADVANTAGES OF USING THIS CONTRACT

This Contract is a General Services Administration, Public Building Service, multiple-award contract that has been awarded in accordance with “Brooks Act” procedures. Firms have been evaluated and selected by GSA/PBS professional staff based on technical merit and their ability to provide a broad range of structural, seismic, and blast engineering services. Because “Brooks Act” requirements exist government-wide, GSA/PBS has made this contract instrument available for use by Executive Branch federal agencies that have a need for professional services.

Use of this contract provides for efficient and expedited procurement. GSA has pre-negotiated hourly rates, overhead and profit based on government audit. Each agency negotiates and contracts directly with Rutherford & Chekene/ Weidlinger Associates for each Task Order without direct involvement by the GSA contracting Officer. Contracts can be put into place as quickly as the Agency’s procedures allow; often in as little as 3 to 5 days. GSA/PBS Region 9 allows for use of this contract by all Executive Branch Federal Agencies.


HOW TO USE THIS CONTRACT

The ordering Agency shall assign a qualified Contracting Officer and Contracting Officer's Representative (COR) for each Task Order issued. The ordering Agency is responsible for all aspects of ordering, administration, acceptance, payment, modifications, close out, and any claims rising from or related to any task order issued.


Ordering typically involves the following steps:

    1. The ordering Contracting Officer's Representative (COR) drafts a project specific Statement of Work (SOW) that includes the services, schedule, and deliverables to be required under the task order. GSA has developed standard SOW’s for Seismic Hazard Evaluation, Blast Vulnerability Assessments of Window Systems and Progressive Collapse Assessments.     2. Since being awarded using “Brooks Act” procedures, the IDIQ contract stipulates that all task orders being placed on the contract are to be qualification-based selection. Multiple firms should be given consideration, as appropriate, in accordance with the fair opportunity requirements of FAR 16.505 (b) 1.i. of the master contract have been made to the three most technically qualified Contractors.     3. After qualification-based selection, the ordering Contracting Officer will request a firm fixed-price cost proposal from the selected firm.

    4. Upon selection, R&C/ WAI will prepare and submit an initial price proposal to the ordering Contracting Officer within three (3) working days, unless a longer time is requested and approved due to the complexity of the order.

    Proposals for performing the required services will be submitted on detailed GSA Forms 2630.

    Architect-Engineer Cost Estimate, and the GSA Form 2631

    Architect-Engineer Cost Estimate Summary, or equivalent forms provided by the ordering Agency. Prices will be based on pre-negotiated hourly rates, the estimated levels of effort for each Discipline/Labor Category, and reimbursable expenses.

    5. After the successful completion of level of effort and price negotiations, revisions to initial price proposals will be submitted by R&C/WAI within one (1) day. If agreements cannot be reached, neither party will be under any obligations to the other concerning the services covered by the particular draft contract Task Orders.

    6. R&C/WAI will commence work upon issuance of an executed Work Authorization.

    7. The procuring (GSA Region 9) Contracting Officer does not require that ordering Agencies submit copies of the Task Order, the determination for most technically qualified firm, or the Work Authorization.

    8. R&C/WAI will file quarterly Contract Reports with the procuring Contracting Officer on all Task Orders against the Indefinite Quantity Ceiling (IQC) that are requested (pending obligations) and issued (established obligations) from ordering agencies.

    GSA/PBS Region 9 and R&C/WAI are committed to customer satisfaction. In order to assist in monitoring the quality of services provided, we request that the ordering Agency complete and submit a copy of the Contractor Performance Evaluation form to the Contracting Officer after the completion of each task order placed under the contract.
